I use Ebay often, and they do have buyer protection, especially if you also use paypal.
They also offer contact the seller....and you can report fraud or abuses.
Sadly however, it is used perhaps, and that may only mean the seller has tired of it. The fact that the seller hasn't offered many items for auction isn't a reason to condem them as a Pirate however. It just means exercise caution in unseen, untried purchases.
You get what you pay for is an old adage, but a valid one. Obviously you need to contact the seller first. I did that with a DVD that malfunctioned and was ready to give negative feedback until the seller wrote that they'd replace the DVD free of charge.

Everybody starts somewhere. Most of his positive feedback is from buyers.
His shipping charges seem high, however. How much does an x-box game weigh? Virtually nothing, right? I thought Priority Mail was about $3.20. I hit "calculate" on this auction, and it was over $9.00.
Maybe not.
Look for someone with more realistic shipping charges!
I just went to http://www.usps.com
Priority Mail for 1 lb or less from California to where I live should be $4.05 (per US Postal Service). This auction calculated the shipping at $9.05 for Priority Mail to my Zip Code ("All prices include any packaging and handling fees charged by the seller...")
If you bid, I bet you'll get your item, but you'll pay too much for shipping.
ALWAYS read the ENTIRE auction listing CAREFULLY. ALWAYS check the shipping charges AND feedback!

I looked at it, and going through ebay, keying in the auction item number and hitting enter, it seems to check out. It's not a clone site scam or anything like that.
May I suggest you pay, or get someone to pay for you, with paypal, attached to a credit card. If the dealer doesn't deliver, the credit card, and not ebay, will refund your money back to your card.

If you use PAY PAL, they guarantee your money is safe. If you do not get the game or it is damages in some way or not as advertised, just file a compliant with Pay Pal and they will get your money refunded. I have had to do that a few times with them and never ever had a problem. Been buying on Ebay for years.
