I wrote a check to help pay for something my family bought for my grandfather. I've been told by my cousin that the owner of the business told her the check bounced and stated he needed to be paid. This was about 5 years ago. I never received anything from this person stating my check bounced. I've never received anything from a collection agency either. Since it was from so long ago, I no longer have that bank account (small bank in a specific town). I have no way of checking to see if I did bounce the check. It just seems like he would have sent me something. I also don't like that he has discussed this matter with someone other than me. My main question is, legally, is he allowed to do that? It seems to me with all the privacy acts, there would be something covering an issue similar to this. I wouldn't expect for a credit card company to call me and discuss my father's account with me.

Legally, the only matter that the rep would have been able to discuss with your cousin was your current whereabout, without revealing the specifics as to why!! More specific info available at http://www.ftc.gov/bcp/conline/edcams/credit/coninfo_debt.htm

If a check bounces, your bank will alert you. They usually charge customers for bounced checks. Also the man at the store could have re-deposited your check after verifying the money was in the account.

Original creditors are not bound by the FDCPA, so they can pretty much do what they want in that area. Unless there is anything in your state statutes that prohibits it.
