my mom could not pay for her house so she had to move not she's being taken to court i live in texas.

your mom is being sued for foreclosure......unless she wants to fight the foreclosure....she doesn't have to do anything.

or...she could file Bankruptcy and rid herself of the judgment that is going to happen as a result of the foreclosure.

Seek out a Bankruptcy lawyer...ask questions to them.

Bankruptcy doesn't have the stigma that it once did.

Your mom's house is being foreclosed because she is not paying her mortgage. That means your mom defaulted on the loan and the bank is taking her home because it was used for collateral to obtain the mortgage loan.
My question to you is if you can afford an attorney to fight this in court why don't you just use that money to pay the monthly mortgage payments so the house doesn't foreclose???
Have her call the lender and ask them what it would take to halt the foreclosure process, they usually are willing to work with the borrower because it is just as much a headache for them to go through the whole process.

She should not have moved first of all ! Now it is a civil matter,
they will sue her for what is owed less what they can sell it for !

a real estate atty. and you should call her lender & see if you can work something out. Banks really do NOT want to take back your real estate.
