I went into a store looking to buy a new camera phone, when I opened the phone up a picture of a man's genitals was on the main screen. I called the store to let them know. The store reported it to the police, the police called me, telling me they know who the person is who did this as he also took a picture of his face with the camera phone. The store does'nt want to file a compaint as the person comes in the store quite often. They said they are angry but won't file a complaint. I fill this person is going to just walk away with just a slap on the wrist. The police said I can file a complaint but to be prepared to go to court. I feel that the store should being filing the complaint. What should I do and what steps do I take ?

My 16-year daughter was the one who picked up the camera phone and found the obscene picture on it. I feel the store shoudl have had the camera phone displayed were it could have been monitored as to how it was being used.

i would file a complaint b/c doesnt that fall into pornography if the store has identified this person knows who they are? i would not let this go and talke to the mgr. of the store or get the media involved someone like that should not get away with this god forbide your child saw this on your phone thats sick for this person to do that or if they still are lazy- the store id sue em you have every right to fill a complaint against that store and this person esp. if the store knows who did it? that sounds fishy to me

the store chooses not to. Since you are the one who brought the original complaint to the store then you should be the one filing the complaint with the police. Now you can include the store as a witness.

I personally find things like this to be rather minor.

If it was "sexual assault" proceed as such. If it wasn't then whatever.. sexual assualt is a serious crime.

Intent is the big thing.. chances are it was a prank. If it was sexual dysfunction they may need help. As exhobitionism, may perhaps lead to more issued occurances.

Talk to the guy.
If you have a bad feeling about public safety proceed with charges.
If you suffered personal damages from the occurance sue.

Call the main office of the business and explain the situation. They will probably handle it to advoid negative publicity. If they refuse, you would probably be able to file a civil suit.
