It's funny you should ask... There's a riders right's advocate and ABATE member (naturally...) that has been cruising up from SC (no helment law) into NC (helmet law) riding lidless just to see how long it would take to get pulled and what would happen.
After a year of riding lidless in certain areas of NC he got popped around Maggie Valley a couple of weeks ago and is now in the process of attempting to fight the ticket, just to see where it goes.
My guess is that he's going to pay the fine and cost of court and end up with points on his licence, we'll see.

California will pull you over. The question is if the officer writes the ticket as an equipment infraction or a saftey infraction. Saftey infractions carry a stiffer penelty. Equipment infractions are a fix it and pay to pass problem. The problem most courts are seeing in California is not riders without helmets but riders with helmets that have not met DOT standards. Ironically, the only organization authorized to determine if a helmet has met DOT standards are the testing labs of the DOT. Therefore, how can an officer or judge look at a helmet and determine and certify if a particular helmet has met the standard or not? As long as there is a sticker on the back of the helmet, what else does the law require?

it can depend on where you are and how good a day the cop is having. I live in arizona, we dont have a helmet law for people over 18. i ride into california to cross the border into mexico now and then, california has a helmet law. I've been stopped a few times and never once gotten a ticket, but am sure i will one of these days. the fine is a few hundered bucks and some points, same in most states.
i think it should be left up to the rider. in the summer in arizona 115* plus heat a helmet just doesnt work for me. yes yes i know i could get killed or turn into a veggie, but the same could happen if i passed out at the wheel from heat stroke because i got stuck in traffic for 45 min in a fricken helmet! I hardly ever wear a helmet, i think maybe 3 times this year. otherwise its my choice. boo hoo about insurance rates. . . its america we all get choices.

I'm in California, I do a fair amount of riding in Nevada and Arizona. *** Helmet Laws Suck***.In Ca or Nv. If a cop sees you w/o a helmet you will be stopped and cited Nv.$$ not sure Ca. $265 a few years ago. Most cops will let one get away with the lightweight skid lids even though not D.O.T. approved. The really bad part is w/o a helmet the cops won't let you leave the stop on your bike. They can tow it or tell you to get a helmet and come back. That's part of why I love Arizona , Before I'm across the bridge that FU(K'IN helmet is off.

Here in Michigan, if a cop sees you with out a helmet. You WILL be stopped. Now the cop can write a ticket and let you go, or you can loose the bike right there on the spot. I don't know how they figure which to do to a rider. My guess is if his wife ran off with a motorcyclist last night, you're doomed.

Well in Philly there are no helmet required, And we have more motorcycle death then most states. Also keep this is mind It is not you that you should worry about its all the other *%^holes out there on the road then seem to be so dangerous to each other in cars I would never consider not wearing one, it is not me I worry about It is all the other out there.

If the police see you w/o a helmet in NJ, you WILL get pulled over, and you will get a ticket. Not sure on cost, but it ain;t cheap.
What alot of bikers don't realize is that everyone's cost of insurance goes up each time some dumb, helmetless biker cracks his head open and ends up as a vegetable. His/her insurance would never cover those costs, from the premiums he/she pays, so we all end up paying for that "freedom".
