A friend of mine got asked by a photographer to be a model for a photo session. She's a very beautiful girl, but not at all a professional in that kind of business, she just met the guy in a gym and started to talk. She would like to do it - she checked the site of the guy, it's a serious guy, nothing obscure, no nudity - but she'd only get a print of herself, even though the photos are going to be sold. She's a bit naive in money stuff, so I ask the big question for her : Is it legally correct to ask someone to model for commercial photographs without paying her? Does the photographer HAVE to pay her?

If he is going to sell it of course she needs to get pay, if he doesn't, talk to her and convince her not to do it.

If it is NONnude, and NOT for adult sites (the way to tell this is ask if she has to provide or let the photographer copy her IDs)...and the guy is GOOD... then "TFP" is fair.
I personally prefer "TFCD"- which is where I get a cd of the images. This saves me scanning :)
Getting paid, even a small amount, covers everyone's asses. If I photographed people, I would always have a signed model release and pay them something (even $25)-- because I am unsure if it is a legally valid contract unless money is exchanged. "Prints" and "digital images" are of such negligable value- I prefer something more straightforeward.
However, it happens alot. I've done my share of "TFP" and "TFCD". It's a great way to build your portfolio and get some AWESOME images of yourself!

Is she out of her mind.. I see cases like this all the time on Judge Judy, etc. She should NOT do it unless there is a contract.. I am sure that the guy wants to do it for free so he can sell the pictures for bucks..... No.. I would NOT do it.. Even with a contract, it would be very difficult to determine a fee.. particularly for a guy who may not have much and furthermore,.... not knowing what his intentions are. DO NOT BE TRUSTING on something like that

Modeling in a job, and any job requires financial compensation.. She should ask how much the job pays weather she is experienced or not... If he says he won't pay, then she shouldn't do it.. I back out of a fashion show for that exact reason..

technically, he is paying her, just not with money...he is giving her the PRINT, which could be valuable if she were building a modeling portfolio...she should get the photographer to allow her to make as many copies of the print as she wants...

a model has to pay her dues before she can get anywhere as a model. Once you are with a reputable agency, that is when the cash starts to flow.

the first thing i would have asked is how much will i get paid. it sounds fishy to me, but if she's set on doing it maybe she should take someone else with her, incase the situation gets sticky. if she's not getting paid and she's ok with that at least she could use the photos in her portfolio.

Not if she agrees to do it for nothing. It is called exploitation, and many bastards do it to people their whole lives. It is barely legal, but not ethical. Why not contact the police bunko squad, maybe he does it a lot,
maybe he slipped up once, or will.
