well, that's what my brother said. but he did say that making one based on it is llegal though. but is there any way to get permission from the people in charge of the movie to make an action figure of one of there characters? the reason i ask is cause i found this one website called andgor.com where you can ask them to make an action figure of yourself in your own way!

The characters from a movie are considered "intellectual property". It is an artistic endeavor just as a painting is. The creator has a right to benefit financially from his characters.

Actually, it is illegal to create an action figure for financial gain, without expressed permission of whomever holds the copyright. If you are a StarWars fan, and make your own action figure for your personal use, you are not violating any law. If you sell that figure to someone, you are.

In the particular scenario you mentioned, andgor.com would be profiting from StarWars if you had your likeness made in a Han Solo outfit.

It *is* okay to make one, but not for purposes of selling it, because the company that made the movie owns the trademark to it. The only exception would be a company that makes such action figures and has a specific license to do so from the company that owns the rights (e.g. Playmates has a license to create toys and action figures based on Star Trek).

Many professional modelmakers in the film and TV industry get their start by creating models based on their favorite movies or TV series. I go every year to a science-fiction convention in Toronto called Toronto Trek (http://www.tcon.ca ), which has among its features an art room displaying drawings, sculptures and models.

It's not illegal unless you try to sell it. If you want to sell it you need to obtain a merchandising license from the copyright holder.
