Just bought our home w/ help from MY parents. My job is near our home, his isn't. He refuses to leave and asks "Why should I be the one to leave?" Is there anything I can do to get him out? Both of our names are on the mortgage.

Why do you want him to leave? Trial seperations are a precursor to a divorce. He has a right to be in the home with his child and one in which he is helping to pay for.

It is his house too.... almost every "trial" separation I've ever seen or heard of was a prelude to divorce. If your husband moves I'm sure you will expect some support from him won't you? I don't blame him for not wanting to move out - if he does he has to pay and will not be near your child. I take his side, I think you are wanting to have your cake and eat it too.....

Legally you can not force him to move.

court order can get him out - talk to your lawyer.
