tenant broke lease ok I decided cheaper less aggravation let them go,now the tenant demanding the immediate day of move out to refund his security. My concern is in the next two weeks I'll notice things not working (everything was new) and have no
recourse.Tenant is writing this proposal down for the record so I don't take any action in the future against him. I won't sign anything or even accept his registered mail. I just want him out and will write this off as a loss

Legally, you have 2 weeks to return a deposit, after you regain possesion of your property. By law, you have the right to deduct for painting, carpet cleaning, and damages done to the apartment other than wear and tear. Do not sign anything, and do a walk through with them, and list any potential damages in your walk through, take pictures, and have them sign the walk through papers.

If they broke the lease they forfeit the deposit, but if you are a giving person you could return it, but by law you have up to 30 days to do so. Personally I 'd keep the deposit and they would be lucky if I didn't take legal action for the remainder of the lease.

please do yourself a favor and give them their deposit back or else you will be the one in trouble if they decide to take this to court . My mother is a landlord and let me tell you she tried when the tenant broke the lease to keep the deposit. Well they took my mom to court and she got a royal chewing out by the judge. he said she should have been ashamed of herself for trying to swindel these ppl. just give the deposit back and be done with it. If anything is broken take them to court and make them pay for it .

I believe you have a few weeks to refund his deposit. Check with a lawyer. BTW you also have to pay him interest on his deposit, at least here in Massachusetts.
