My sister is in an abuseive relationship.She finally left the guy and went to another state.She took her 1 month old baby with her and is planning on never comeing back.She has no leagal proof that she was being abused and of coarse he will deny it.Can she get in trouble for takeing the baby?They have not wen't to coart over custody.She had to leave without him having any idea.

She tried to make a report but they told her that since she retaliated back then she couldn't press charges.He kicked her so she punched him then he beat her up real bad.She called the cops when he passed out from being drunk.The cops came and told her to have someone come and get her.We thought they would arrest him when we left but they didn't even wake him up,they just left after us.So she wen't to another state.He is the father on the birth certificate.They are not married.

She needs to file through an attorney in the state that she left. This is important, because if he were to file before her and ask for custody, he could get it. She probably needs to get into a womans shelter. They have soooo many resources for women. Housing, food, medical help and most importantly legal help. Call your local police department and inquire about local womens shelters or she needs to call the local police department wherever she is.

Yes she can get in to real trouble. Crossing state lines makes it a federal offense. No with that scare i doubt if there will be much done about unless the father files charges against her. He can do this. Just wait and see what happens. If your sister has to go to welfare to get help then they will definitely go after the father. That will be another problem. This is rather common and most of them are settled rather quickly and without much problem. Some do end in real disaster.

I'm pretty sure he can't charge her with kidnapping, she is the mother. I don't think they can charge a father with kidnapping either. She just needs to lay cool for a while and keep away from him. She doesn't have to have proof that she was being abused. Cause he's a violent guy, he'll probably have a angry outburst in court, then he's gone....

Are they married? Is he on the birth certificate? I think that if they aren't married then she has every right to do as she pleases with the baby...until of course he decides he wants to go to court for custody then she will have to appear and go forth with the proceedings...but she needs to let someone, a shelter, the police, anyone...know what has been going on and why she is doing what she has done so in case he wants to get "even" or whatever with her. I pray for her safety and that of the baby as well...Good luck!

she could get in trouble for keeping him from seeing the baby because as the father he has rights whether he is paying child support or not. She needs to go get a protective order so she will not get in trouble if he ever does track her down.

I suggest she gets married and changes the babys least name too so he will have a hard time finding her,

There are a lot of variables in this situation. The first one would be were there any witnesses to the abuse. Did he hurt the baby?
Is your sister or the baby still at risk of being hurt?
I would consult a lawyer.

i don't think that the law will charge her unless there were papers of a custody agreement. it may have been best if she did leave if he was physically abusing her.i just hope she will stay hid out for a while because he could hurt her if he found her. my best advice is to tell your sister to find her a good lawyer and talk to him. he could probably protect her.

If they were married I THINK maybe she could be.If they were just dating or living together i dont hink so because neither one of them had legal custody,they will have to go to court for that.It is worth the risk she made the right desicion to leave him for her and her babys sake.Be there for her she will need alot of support.

oh wow, did he sign the birth certificate? if so then yes that is considered kidnapping!!! She needs to go directly to the police and let them know. make sure she talks to a lawyer ASAP before he realizes he can bring her up on charges! Trust me it is kidnapping if he is on the birth certificate!!! if not then it isn't! she needs to contact someone right away to help her!

Depends what the father decides to do. Perhaps he is happy that they are gone.

Be supportive of your sister. If she says she was abused then she was. Cut off all contact with her ex.
