My lease was up in sep.1,06 i gave them my thirty day written notice, tried to pay the full balance but still had $40 left as of sept.09,2006. Now there trying to charge me $700 to get new carpet and we didnt even get new carpet a yr. ago when we moved in is that fair???

just get the carpet cleaned

reasonable wear is expected. What does your lease state? review it. I hope you did NOT give them your Social Security Numbers (because may landlords like to go after your credit). Some states require that the LL notify you in writing and provide you with certain details. Take pictures of the carpet before you leave the place. Also have them sign off as to ALL damages on day of vacancy when you return the keys (not the day after). Check the law out in your state as to what the proper procedure is to get your security deposit back. Some states require it be returned with in 20 days of return of keys, notification of new address and vacancy of building. In my state the penalty is amount due plus 3 times this amount.

if you damaged the carpet beyond fair wear and tear you are liable for the cost to repair or replace it. this money should be taken out of your deposit. i used to manage an apt complex and i always told people to take photos or video the apt when they moved in as to have a record of any damage. if you can't do that, be sure you write down on your inspection list (you should always get one of these) everything thats damaged in any way and give a copy to the landlord and keep a copy!

The landlord can't charge you for normal wear and tear. Unless you completely destroy the carpet in a room, I don't see how they can charge you that much. Find a landlord tenant service in your state (most states have that). They should be able to help you.

They should only charge you for the carpet if you damaged it, and they have to replace it.

If you damaged the carpet, they can do it, if not they can't.
