me and my girlfriend want to go move in with my uncle,who happens to be my only relative close by.my dad moved out of state and left me in texas (current location) and i dont know where my mom is so i know i wont have any problems going. but my girlfriend is 17 and she lives with her mom,who is an alcaholic.she mentally abuses my girlfriend to the point that she calls me in tears sometimes.i need to get her out of that house, but i know that her mom would file her as a runaway.if her mom did that, would she have to go back home?i know its different for every state, i just need a clear answer on what to do.

Depends on where you live. Some jurisdictions consider a 17-year-old to be an adult, and the police won't classify them as a runaway. They will tell you to wait three days and file a missing persons' report instead. Your girlfriend needs to report her mom's abuse to the nearest social service agency. Moving in with your uncle could cause some legal problem--her mom is still her legal guardian and demand that she come home.

Your girlfriend needs to go to the court house and file a petition for emancipation. Her mother couldn't do anything if she was emancipated from her parents. Unfortunately, the police could come take your girlfriend home at the age of seventeen. Of course she could claim emotional and/or physical abuse and they might take her to a safe house. It is probably best to emancipate herself if she is living in an unhealthy or dangerous environment. I can't see the State of Texas going out of their way to find a seventeen year old 'runaway'. They most likely have better things to do.

Call someone and ask them what you should do. Or tell them that your girlfriend is being mentally abused by a drunken mom. I think you should talk to the local authorities before you leave the state to make sure you can do things legally before shes 18. Call the courts out there or ask a lawyer what she should do. I think you are a great boyfriend for wanting to take her away from that situation.She should be lucky to have you.

ya she will file her as a runaway they will not make here go back there but if she tells them what her mom does they will put her in states custody and that sucks big and if you are over 18 you will get put in jail for 3 years if you held her as a run a way bad choose wait till she is 18 and then do wait the fu23 you all want to do wait

Have your girlfriend file charges against her mom for neglect, and then have her move out...she'll have things documented and the fact she's almost 18...the runaway issue may not come up..I'd get her couceling as well..she's going through a tough time...keep being there for her...

Check up on what the state says the age there is.........here in South Carolina, I think the law officer we spoke to told us 17 was technically the youngest you can be "out on your own". But that was just for SC so who knows if Texas is the same.

my advice would be to call your local abuse hot line and ask what the laws are in your state. you don't have to give your name if you choose not to. please don't run away.especially if your 18 or so.you could go to jail. if you both decide to run then let your local police dept. know at some point so people do not think some thing bad happened. think this over very hard as living on the streets is hard and dangerous.

You may have to call the police to ask them but I think that until she is 18, she is a minor, and could be deemed a runaway.
