Your email address and password are probably embedded in the old computer.
Log into your email and change the password.
You have no case to prosecute, you left the information on the PC, and he can say he didn't know.

You don't say whether he has e-mailed your contacts from your account or from his. Much of your personal information is stored on your old computer. For instance, if you use outlook there is often an old file of all of your previous emails-both sent and received stored as mail.hst. When your computer asks you if you would like to archive old items that is where it puts them. If he has been e-mailing from your account then he has your username and password. Simply change all of your passwords to something that he does not know. Also, you need to check for a password stealing program on your current computer. Scan for viruses and also look to see what programs are running on your computer at start up by hitting control-alt-delete after your computer starts.

Change your password. Sometimes the cookies on your pc will save pages, like when I go into yahoo it just comes up with my email, I dont need to put in a password. The old pc might be opening up your email automatically

You can't prosecute.
you need to change your password as soon as possible.
he already has the list of your contacts though, so he will always be able to email them. There really is nothing you can do about that. Hopefully they will treat his emails as spam, and he will leave them alone.

It is very likely you have a Trojan on your computer. Try downloading Ad-Aware and Spybot and run them. If there is something planted in your email area, those programs should find and delete it.

just change your password and/or your email address also---just get your email address you have so you can contact them and let them know of your email change.
