We have 5 kids together. I don't think she wil take them out of school. But how long do I have to wait to file for child support after she leaves the state. I'm in Michigan. We haven't file for divorce yet. And we own a home. Also, there has been no abuse of any kind on my part. She just wants to get a new life. She is relocating within her job voluntarily. She's trying to just jam me....any ideas on my course of action.

Son...you need to obtain an attorney to get some legal paperwork that orders parents can not take the children out the state without approval from the other parent. You need to obtain her SSN and once/if she leaves the state, either go to social services or your attorney and file for child support.

I would try to be the one who files for divorce first, before she gets out of state. Did you want her to take the kids? If so you could always move and not tell her where you live for the time being. But definitely file and make arrangements for her to pay child support effective as soon as you no longer live together.

You already know when she's leaving, just better prepare yourself. I don't thingk you can file for child support just yet because she's still living in the house. Once she leaves without them you will probably have a good chance. Good Luck!

seek an att. NOW. ask for joint cust. w/u as the domicillary parent which means they live w/u. this way if she wants to leave she can but w/o the kids and ask for c.s. give her limited vis. but only within the parish you live in. this way she cannot leave the parish w/ ur kids during visits. let her go get a div. but man fight for ur kids they need to see someone loves them and will fight for them instead of fighting over each other.

Yes, go now and get a court order that will not allow her to leave the state with your children.

Hey sorry abt ur situation, but ur only hope rite now is gettin a lawyer to defend u and ur struggle with getting ur divorce final with no fights i suppose.

If your worried about losing your kids than take her to court. But if your scared that she is trying to devorce you than let her, but if she does than she's not worth keeping anyway. But either way you need to fight for your kids, like joint custedy or something.
