This what the local oil jobber did. In his lease he wasn't up front with the business about the tax he has to pay this jobber. The tax was written into the lease and those leasing oil weren't told up front about this. What I want to know does this bussiness have a right to sue them.

anyone has the right to file a lawsuit for any reason, now to as winning or losing that suit it up to the (facts) or what is presented and a good attorney,
your chance of getting something settled are greater with the threat of a suit though! even if your a restaurant or a local oil jobber

about 5 or six years in the past I had a 24-hour case of foodstuff poisoning from a tuna melt I had at pleasant's. i did not sue, yet I also did not eat tuna back for over 3 years.
