The answer to BOTH part of the question is the same, the FEDS. They are the ones that are in the position to remove those freedoms (been on an airplane lately?). While they will use the actions of terrorists to justify taking those freedoms away, the truth of the matter is, they have done it for a long time without any terrorists. The best way for a government to ensure its power is to take away the freedom of the people to protect themselves from and object to that government. Just ask the Nazi's, that's how they did it.
