Yesterday my boyfriend and I bought a Sony Playstation 2 from a reputable store (in Canada). The package was to include the playstation, a memory card, a contoller, and the adaptors. We paid full price. When we got home and started to set it up, we found that it was used, the controller was missing and the adaptors were not only the wrong ones but were also used. When we went back to the store today to get a refund, they refused. They even went as far as accusing us of stealing the controller and adaptors and replacing them with the others. They refused to give us the name of the store manager and proceeded to call security on us. We were calm and would have settled for an exchange but not now. All we want now is our money back so we can go somewhere else to buy a PS2 for our son's birthday but they won't give it back. They followed us out of the store and everyone in the store was watching, I was mortified! What should we do? Isn't what their doing illegal or something? Anyone know?

i work in loss prevention (security), and if someone called me and told me people switched, i could not follow them.

all i could do is watch them, to see if they switched anything in the store. accusing someone of theft without any basis is a sure fire way to get sued

one thing you can do is go on their website, and look for a customer service number. call, and attempt to get things fixed, they usually pressure the store into doing things the customer's way.

you could also seek a lawyer, and have him contact the store. he would let the store know that they will shortly be sued for theft, defamation of character, accusation of a crime with no basis. if everything in the story is in place, and accurate, there is no way you could lose that case

in the future, from ANY store, when you leave with a package, inspect the package. if you are going to open it when you get home, open it there, see that everything is there. if it's a gift, check the taping of the edges. make sure the tape is in place, there is no scotch tape, and no ripped paper under the tape

If you have money, Go elsewhere and buy another. That's the problem with retail. It's always a good policy to get EVERYTHING you need through a friendly contact or connection. You know you wont be stifled or ripped off ever. That's the problem my parents always had as I grew up middle classed. Now everything I get is specialized, tailored, or somehow unique. I'd suggest letting it go, you can't beat big business in a lawsuit. They break out the big lawyers (even if the cost for court is more than your asking) simply for the principle of it. I used to have friends that would suggest having someone be paid to go in the store and steal the equivalent, perhaps a shifty employee or the like, but I don't condone that. I'd let it go and get another elsewhere.

Wow! Most places would never do something like that! I would start by calling the store manager and you should have taken down the names of those refusing you the right. You could even call the district manager. It does not sound like a very reputable place if they refuse to let you speak to a manager? They should at least replace it, stores have insurance for that. It was probably a prior customer that did the switch and they never bothered to check it out or it's the employees. If that does not work there is always bad press no one likes that, go to your local station or news paper. Freedom of speech! You have the right to warn your community :)

You want the REAL answer to this problem...???

You get a BIG poster saying "CHECK YOUR PURCHASES BEFORE YOU LEAVE A STORE"

"OPEN THE BOXES IN FRONT OF A SALES PERSON"

Then walk up and down in front of the store displaying the poster...

Stay on the public sidewalks...

Have someone stand by with a camera.

You will be there only about 30 Min's until they try to run you off. You tell them you have a right to be on public right-of-way. And that your only advising people to buy with care.

If anyone seems like they are going to get rough, (including the cops) point out the camera person...

When I did this (in the USA) it took 45 min to get my corrected purchase.

Report them to the BBB or go straight to the Manager of the store.

3. They will probably settle out of court to avoid the risk of being found guilty of fraud.

and sue the crap out of the store!
