I'm in sales and a coworker of mine sold a deal in my territory. When I brought this to the attention of my manager, he made us split the commission. My coworker is obviously a spaz and started getting real loud with me and caused a scene and said you don't know who you are f***ing with. He was totally out of control, but I kept my cool and never raised my voice. He was also talking trash about me when I wasn't at work yet, saying really loud that I have sex with prostitutes. Should I go to HR and issue a formal complaint? What are the repercussions to me if I do this, if any?

I would, but this is like firing a gun...you don't know who it will hit and you really can't call it back...make sure you have a good lawyer and maybe you will get a settlement...be prepared to be blacklisted though.

Depends if you really are having sex with prosititutes. What I really mean is, does he have any dirt on you that you want to keep under wrap? If he does, than I would count on his nasty attitude getting him fired soon enough and just leave it alone.

If you issue a formal complaint it may help get him fired, but thats about it. Figure out if that is your goal or not.

If you really feel threatened by this individual in the sense that you are not safe, than definatly formalize those feelings.

I think you should talk with your boss before you go to HR. If those are the rules in sales then you are not incorrect to do what you did. Screw that guy. You are just trying to make an honest buck like the rest of us. That guy should have known that was your territory to begin with. Its his fault.

File a sexual harassment claim. Sexual harassment covers hostile working environment, which your manager is responsible for. If anyone were to mess with you after filing a sexual harrassment charge, you could own that company. You will see a big difference and be treated better if you file this charge, although I would give my manager a chance to straighten this out first. If he couldn't straighten it out in two minutes, I'd file sexual harrassment.

You need to file a sexual harassment suit against this individual. Follow your companies chain of command, you need to notify your supervisors, security, union, HR, and the police if this person has threatened you( and it sounds like they did). People do crazy things when it involves money, this person could come back on you.

Yes by all means report the guy to your HR department but you must have incontrovertible proof as to the veracity of your complaint.

You already took half of his commission for him doing your job. I say drop it and hope it goes away.

Since you kept your cool, and half the commission, it is obvious that you won this round. Just sit tight and let that idiot set himself for failure. It is only a matter of time before he barks and offends the wrong person.

Only if he continues the behavior would I complain. People get upset, and do crazy things, and say crazy things. But if it continues then you need to do something.
