i think doing anything idiotic while pregnant should be illegal. and for those stupid enough to engage in such acts that harms a child, it should be a crime for them to get pregnant in the first place.

It is very difficult to legislate behavior on this level. It could never be enforced fairly, for example women in their first or even 2nd trimester may not be visibly pregnant - so if you stopped everyone in their third trimester (visibly pregnant) you would not be solving the problem, in fact I think I read where it is more harmful to the baby early in the preganancy than later.
The only way you can stop pregnant women from stopping is - outlaw all smoking! The day is coming I'm sure but it will be awhile, the tobacco lobbyists have a lot of money and power to keep it going as long as they can.

Ok first of all , it would really be ironic if the law prevented a woman from the slight possiblity of harming her unborn child while smoking and at the same time let it be perfectly legal for her to go to a doctor and have it slashed to bits and sucked out! Smoking has only been shown to cause low birth weight. Not that that is good, but should the government now tell a woman that she is eating too much sugar and there fore increases the risk of infant diabetes? where do you draw the line. Crack and heroine are illegal and so there is back up to arrest someone. Until this country stops being duplicitous and wants simultaneous protection for the unborn and the absolute right to murder it, then the government should just mind there own business!!!

I have always felt that smoking was the stupidest thing that any smart person could do. I am not saying that the person is stupid but the act of smoking is. I have never smoked I hope that any one that becomes pregnant can stop for the sake of the child.

I sympathize with your position but you haven't thought this through.....
Does the word "detox" mean anything to you? Ever been around somebody trying to quit smoking? Not very stable are they? What do suppose their biochemistry is like?
What I'm getting to is that it might be more unhealthy for the fetus to be in the womb of someone going through a nicotine detox than to be inside a woman who peacefully smokes for the whole 9 months.
The ultimate answer to this and a whole range of similar problems is that parenthood needs to be licensed. It's the single most important job in society and yet everybody just mindlessly accepts that it should be done by complete amateurs or worse.
Letting active nicotine addicts have babies is ridiculous, but it's nothing compared to letting active alcoholics do it, which happens all the time. Beyond even that is the truly edifying spectacle of pregnant cokeheads giving birth to "crack babies".

its not illegal but it certainly does a very bad effect on unborn child. we couldn't arrest pregnant women by smoking, its their choice, what we can do is give them information about its consequence though im sure some of them, already knew it.

Smoking is an addiction - like alcoholism, drugs, etc. Its something just just can't kick. It's like you being pregnant, and you stuffing greasy assed MCDonalds down your pie hole - it's bad for you but you still do it - I smoke periodically and i'm 8 months pregnant, and DARE someone to say something to me. It's none of yours or anyones business. And who's to say that anything will come out wrong. What do you think that women in the 50's and 60's smoked when they were pregnant and their babies came out fine, and women that don't smoke come out with a kid that has 3 eyeballs and 56 toes.
This politically correct society is so hypocritical. Society always blames smoking for EVERYTHING, and it's really fuggin old.

Smoking should be illegal period.(I started smoking when I was 13 and quit when I was 41,12 years ago)
So yes put a fine on any smoker.
