i filed chapter 7 in 2000 with my ex-husband, i am now in a horrible financial bind and need to file again, january 2007 will be 6 years, does anyone know how long you have to wait to file again?

According to the new law, you can not file for a chapter 7 for 8 years after a previous chapter 7.

The other responders are incorrect. Can't do their research I guess.

If I remember correctly, I think the waiting period between Chapter 7's is still 6 years.


However, this time you will have to go thru a 'means' test, and if you make more than the states median income you will be forced into Chapter 13 instead of Chapter 7. Oh, and you will have to go through Credit Counseling... at your expense... before the case will be discharged.

6 years from the date you previously FILED not when it was DISCHARGED.
