well, i'm married but left my husband for another man. Because my husband was an *** hole. Well, I think I am P.G. for this other guy. I wanted to know if I am pregnant do I have to does the baby have to carry my husbands last name or can I but it under the real fathers last name

As long as you are married to your husband, this is your husband's child. Doesn't matter if your husband is a pig or not, before you have sex with another man you should have gotten a divorce.

Wow. You "should" give the child the father's last name. Later down the road you may want to file for child support, or maybe the father will want rights of some sort... the child's last name may become a real issue in the courts. The courts can actually order you to give the child the father's last name.
I hurt for you. This must seem like a really crazy and uncertain time... but it is no rougher than what you have already been through. After every rain, the sun shines more brightly.

I would say the child should carry the last name of the father not your husband. Your husband did not father the child so I think it will be pretty bad to give the child his last name instead of the "real father".

If you are married during anytime of this pregnancy it is legally your husbands child. You can name the child anything you like, but the actual father can't sign the acknowledgment of paternity because you are legally married. It sound like you are going to need a DNA test to get the proper father on the birth certificate.

Since you left your husband why would you want to give your baby his name if he is such an a** hole. I would go with the guy I was with now, it could cause confusion when you child gets older if you go the other way.

It should be able to carry the real fathers name. You could ask a lawyer or maybe the doctor could answer your question. If in real doubt, you could always ask for a paternity test to make sure his name is there.

Give the baby the other mans last name. That way he can pay child support.

You name the baby's father on the birth certificate ,but maybe you should get a divorce to be safe.
