My neighbors have been growing trees in their back yards without our consent and the city's approval. We have talked to Homeowners association and they said it is the issue among neighbors and therefore, they don't have the obligations to help. We have written a letter to our neighbors and they just ignored us and refused to talk to us. According to the law, they need our approval to grow trees in their yards. Their trees are so tall that they have block our view. Do you have similar experience and how do you deal with that?

If there are city ordinances that are being violated, then it is a simple manner for you to contact the city code enforcement department or the mayors office by writing and sending a certified letter stating your complaint and they will investigate the complaint. If it is in fact in violation, then the city attorney will handle any legal disputes with the homeowner.
What I don't understand how they should have to have your permission to plant trees in their yard, unless you reside in some type of housing area where the tenants determine what can and can't be grown there.
I agree with a writer that stated the more trees the better. I agree, not only for cleaner air, but to reduce the force of winds and if you live in snow country, it can help reduce your snow accumulation.

Talk to an attorney. What law says they need your approval? It is the neighborhood association's law or a city law?

I don't think you have much choice unless the trees present a danger. You sound like your alone on this one. Majority rules.

You should consult an attorney who specialises in real estate law, who will tell you if the law is on your side, and if the covenants and declarations of the HOA are on your side, and if you have cause for legal action.
