Doesn't matter who's fault, the ring is given with the intention of a future together. Legally the ring goes back, sorry.Been there, just give the ring back. Besides maybe the next ring you will get to keep along with the guy.

If he called off the engagement, then it's yours, but if you broke it off, then you should return it.
Think of it this way: it's a symbol of a promise you made each other, so the one who breaks the promise doesn't get to keep the ring.
The only exception to this rule would be if the ring has some sentimental value to either one of you (eg: his mother's engagement ring, or your grandmother's diamond). Then it goes back to whomever the ring "belongs" to.
It doesn't matter whose fault it was. Only who broke the engagement.
If you want, you can offer to sell the ring, and split the money with him.

the engagement ring is given in the promise of marriage and if the marriage dont happen then the ring has to be returned or the value of the ring returned to the other party

By law you need to give back the ring. You stated it was an engagement ring. If the engagement is off then by law you need to repay him or give it back.

It is yours to keep because he broke it off. Skip the holiday part. It was given as a promise of marriage, holiday or not. That promise of marriage was broken by him. So you get to keep the rewards of it!

He gave it to you didn't he? It was yours before the breakup so why should it NOT be yours after the breakup? It wasn't given to you as a "just in case we get married" gift...it was given to you to with the intent to keep...don't you dare lose any sleep wondering if you should give it back...It was never his...it was always yours....
