The parents. The surrogate does not have rights over the child. They are only contracted to carry and deliver their child, once that's completed the terms are complete, the surrogate is paid, and the child is the parents problem. And they can give the child up for adoption from there if they so choose.

If the biological parents change their mind, the birth mother can still place the baby for adoption. That way, the baby still ends up in a home where they are truly wanted. Many people would LOVE to adopt a child.

There are so many people looking to adopt, but I would think the biological parents are. Sounds like a court case in the making.

Seems to me, the biological mother is ultimately responsible for the child since it's actually her baby. Kind of sad, isn't it?
