On Wednesday California lawmakers launch an ongoing lawsuit against 6 of the biggest Auto makers in the united states, suing for damages due to emissions put off by vehicles. Who is to blame? Are car manufacturing companies responsibole for putting cars on the road and thereby polluting the environment, or is it the people of the great state of California who purchase and operate these vehicles who must be held accountable.

A case such as this would determine liability in so many situations. Why jail the person who robbed you at gunpoint when you could sue the gunsmith for a considerably higher monetary gain. Or, on the flip side of the coin, who belongs in jail the drug dealers or the children they seduce?

My first inclination was to scoff at the lawsuit. Frivolous at its core. That's what I thought.

However, Wizzard2 has a point. This might effectuate change.

My problem is that the court room is not a place to effectuate change. It is a place to enforce the law, not create it. Bill Lockyer is not suing to enforce any California laws or seeking compensation based upon any legal theory actually available. Instead, as Wizzard2 points out, he's doing this to try to shake things up.

That's what San Francisco mayor Gavin Newsome did when he legalized gay marriage in San Francisco. Big problem though -- it's still f#cking illegal!

This kind of Machiavellian bullsh!t should not be allowed. Bill Lockyer should be personally hit with sanctions for this. He's violating the law and he's violating various codes of legal ethics for filing a lawsuit which he has no good faith basis for bringing.

It is lawsuits like this, as strange as they may seem, that bring about needed change. As the government is unwilling to take steps, the people must. Think back to the 1950's, if a person named Brown hadnt sued the Bd of Education we would still have segregation in our schools. Until the cigarette lawsuits, the manufacturers, with impunity, would lie under oath before Congress. IF only our givermnet would dowhat is needed to protect the environment and protect the destriction of our planet, such suits would not exist.

The only protection we have is a free and independant judiciary

Absolutely not. I almost vomited when I heard that.

This is another classic move... File a big lawsuit seeking potentially huge settlements from US Automakers. The same US automakers who:
1. Can't turn a profit as it is
2. Employ tons of UAW members - who more than likely vote Democrat
3. Make vehicles based upon MARKET DEMAND

Remove the market demand by producing better looking, faster, more practical hybrids or electrics. Don't punish our already weak domestic auto industry.

both the auto makers and the buyers should be slapped with a lawsuit, because both contribute equally to polluting the environment. in making the cars, the auto makers pollute the environment. they put the temptation out there for people to buy cars, but ultimately it is the decision of the buyer to buy them. the auto makers, however, make decisions whether to have an "eco-friendly" company or not - i.e. trying to reduce waste and pollution while making the polluting cars.

Yes. This has a direct relation to the automakers producing cars that aren't energy efficient thus the dependence on fossile fuels and over seas oil company kick backs to the auto manufactureres. The only people being hurt is the consumers.

no. if that was the case why didnt they hit every carmaker in the world with a lawsuit? california certainly has at least one of every car made in the world there right? and if they get away with it, soon every country in the world will be able to hit every carmaker with lawsuits for that crap and they all will go bankrupt

Darn right it is! Even if is unsuccessful, it will force the big 6 to move their new vehicles more and more towards clean technology. If not, they see that in the future, they may become liable for the polution that is created.
