Will probably never stand up in court. It is mostly unconscious and instinctual. Selectivity, naturally encompasses all aspects of human nature.

In Australia we had a case of "lookism" being taken to and challenged in court.essentially virgin airlines were only hiring youngish and pretty ladies. Virgin lost and had to change their hiring procedures. In most cases "lookism" would be hard to prove and would mostly occur during the hiring procedure but if it was able to be proven then it would fall into the category of "unfair dismissal laws"

This goes on all of the time. What company would hire a woman who has been severely scarred over her face to work at the front counter and greet people? That is a glaring example, but good looking tall people make more money on average than ugly people.
