If you were the only employee tested, i would say yes. But at the same time, no Judge would side with a drug user. I would get off the drugs then complain, this is what they do take your job away and make your life hell not kill you. Become a good citizen then go back to your boss and show who was the better man. Introversion over extroversion.

did you sign a random drug test form when you got hired? You should have taken it, and then when they tried to fire you for it being positive (because obviously it would be ;)), then maybe you could challenge it, as long as drug testing wasn't part of the deal. You left that part out, so you probably DID sign a random drug test waiver, and you are SOL

You surely can. I would have fired you for not cooperating on such a small matter.
Most companies require that employees sign a contract to the effect that they are willing to cooperate, by agreeing to take drug tests, before they are hired. Did you sign such a form?

It all depends on if you signed a paper saying you would submit to a drug test when you were hired. If you did, then your signature legally binds the document and they can terminate your employment. However, if they didn't make you sign a peper saying you would, then you can refuse.

Yes it is legal. No you have no recourse.
But you are better off passing on the test than failing it. Looks much better to your next employer to say you stood on principal than "I got fired because I get high"

depends who you work for. if it is a government, federal, state, county, or city, then yes. if it is a private company and it is a work condition then you lose again. contact a lawyer who specializes in this field.
