I am on a cross-country team. For those of you who don't know, cross-country is essentially jogging in the backcounrty. You need a wooded area to run. My team goes to a local national park to practice. The park was the site of a civil war battle. People are sueing us because they claim it is disrespectful to run around all these dead people. They try to kick us out everywhere we try to run. We even tried a few places that aren't battle fields and then they claimed our running disturbs them. We should be allowed to run if we want when we want at a public park right? Post your opinion.

By the way... Most of these people are people who are retired and don't have much to do. I have nothing against the old and retired people, but I think these people are just sueing because... a) they have nothing else they feel is better to do. b) who knows? They might make a few bucks.

Not at all. It is stories like this that make me sorry I didn't pursue a law degree 40 years ago.

Without hearing both sides, I don't know exactly what is going on but from listening to your side, it sounds like some folks want to deny you and your group equal access to public properties. As long as you are obeying all the rules and regulations, not running over or through other groups and are paying appropriate fees I think I would look into counter suing some of these folks.

Now to be fair, I would want to hear the other side as well. One thing you said does bother me a bit. You say: "They try to kick us out everywhere we try to run. We even tried a few places that aren't battle fields and then they claimed our running disturbs them.". The second sentence doesn't bother me because them setting around on their fat posteriors could disturb you and that's just 'tuff' in my opinion. But, the first sentence is a bit bothersome. If "they" try to kick you out everywhere you go I would have to question you about "why".

Do talk to a good civil rights attorney. You might be able to get wealthy being the victim of such treatment.

A national park is subdizided by your own taxes. You have a right to be there. What are the people sueing you doing there? Eating weinies and roasting marshmallows? I suppose the dead soilders don't mind that, though. You're not doing anything disrespectful, so don't back down.

Yeah def but cross country doesn't require a park like setting or wooded area....its strictly a paced distance thing. The fact that you can run in a beautiful setting is fabulous.......besides they would complain just as much if you were running down any street in town.

The only reason to not run in through the battlefields would be if your group is causing erosion or you are in some way damaging the structures or environment. If your coach has cleared it with the park authorities, you should be golden to run.

I would imagine the soldiers who died in that battlefield would be pleased to see young men and women redeeming the site and freely using it for something pleasurable and beneficial.
