Kill them. If you dont, and they get caught, they'll be told how very naughty they were and will have to promise to a very grown up judge that they wont do it again!
Or, they'll get caught, locked up, and cost us a fortune while we feed and clothe them, therefore, being doublly robbed.
Verdict: Kill them twice!

They call it the "Make my Day" Law in America.
But even in the UK it may be possible under present legislation.
1. You do have a right to defend yourself using reasonable force. For example it would be considered excessive if a 6'5" man beat a 10 stone teenager to death with a baseball bat. But an 8 stone woman or pensioner might very well get away with shooting a big man if the firearm is legally held and registered as long as they were in genuine fear for their lives.
I think it could be successfully argued that someone home alone with a baby sleeping in a separate room could kill a burglar by if they was afraid he would take or harm the child (even if that person has had the opportunity to escape alone).
2. You must give the burglar the chance to flee if at all possible.

Yeah bruv lets take the US as an example to follow, are you sure or what? there are cases where people have used knives in a criminal way but can you imagine if they could take your gun off you? or are you the fastest gun in the west? Knives and guns are not the problem just a select few who are prepared to use those type of weapons to do harm. The law has to be prepared to automatically jail anyone caught with a knife on their person and if a knife is used in a criminal way then that individual should expect and go to prison for a very long time. Ps, To the yankees answering this question, clean your own back yard before trying to tell us about ours, our kids don´t go into schools shooting down other kids.

these ideas always sound good, as long as you assume the home owner is a nice, normal person, who would only shoot for a very good reason.
then you have to think about the real world, where you've got a lot of more or less seriously insane people, who would apply the "breaking in" or "burglar" criteria in very broad ways. You could walk to close to the front loan, or set one foot on it - wouldn't that be breaking in? You could pick up an abandoned doll on the front loan, out of curiosity, or maybe thinking about walking to the front door and giving it back - wouldn't that initially look like stealing?
Anyway, because of the arbitrary dimension - which meant that, at times in history, some cities or countries were pretty nasty places to live - people have decided that it would be better to have a dedicated Justice to do the job.
Of course, that Justice can't do it all, and many victims of burglaries, agressions, rapes, you name it, will always feel, and rightly so, that Justice never gave them even one tenth of the revenge they wanted.
But still, overall, institutionalised Justice is much better than if each person tries to do him/herself justice.

In Texas, you can Shoot and Kill someone in your home if the break in and not be held responsible. However, you can't 'beat them to death' or shoot them 45 times or shoot'm as they are running away.. etc.
You have to be able to prove that this person you killed was not invited or allowed in. Plus your shooting this person can not be to an extreme (ie shot 12 times cause you had to reload). Your shooting has to be justified that you were only stopping them and if one shot to the leg stopped their actions then you must stop shooting.
But for me, if someone comes in my house, I'm gonna fire until I hear clicks. I will not take a chance of them getting back up and then take my chances with the courts. The only people that have convicted to this type of shooting was those where there was excessive force and/or the victim was know the shooter (ex-husband, drug supplier, girl/boy friend, etc) as there was some doubt as to the true intent of the killing.
Just my opinion!

I agree with you 100%!!!! Trouble is, the police say if you have a way out as in DOOR then you can't kill someone for breaking in. If I am pinned in our hallway (say burglar has a weapon) with no access to front or back door - I can shoot him on the spot. Also was told if you kill him outside, drag is A** back inside and call it self defense. Someone here in Michigan pinned a guy with his truck against his garage door for stealing his television - called police etc. GET THIS - the guy sued for all of his medical bills etc anguish etc and the F****R WON What is wrong with this picture? I say if you want something of mine - come on and try to get it - I'll be waiting for you - and you will be taking the almighty dirt-nap. SEMPER FI

Yes, I believe we should use whatever force is necessary to protect ourselves, our family and our property. If that turns out to be deadly force, then so be it. We are not trained professionals and that is the chance the criminals are taking when they unlawfully enter someone else's property.
I don't believe most of the police don't care. I just think there is so much crime going on, that unless they can catch them in the act or have their fingerprints on file, there isn't much they can do. I have a brother and two nephews in law enforcement so I could be a little biased or maybe I am just a little more informed. :-}

I think that anyone braking into someone else's house should be treated as a potential danger. And any burglar should be conscious, that he/she may be attacked by the owner of the house protectim himself.
Therefore if anybody decides to become a burglar it is at their own risk.

I don't think we should have a right to 'kill' them per se, however I do believe that a person has the right to defend what is theirs and to use any force that is necessary. If that meant a burgler being killed because you defended yourself when they attacked you then so be it- they shouldn't have been there in the first place.
In any case, the law is far to weak and I would much rather see strong justice prevailing for offenders who are caught.
