If it says 35, that means 35 is the maximum speed allowed under safe driving conditions. If you were doing 35 in a heavy downpour and you hit somebody, they could win in court by arguing that you were driving too fast for the conditions. So posted speed is maximum allowed under optimal conditions.

Speed limits are absolute. However the grace allowed by police is not. Where one police officer might let you get away with 40 in a 35, another might cite you for going 36 in the same zone. Ultimately, the 36 ticket writer would be correct in the eyes of the law, but I think some latitude within reason in the eyes of police never hurts.

35 means 35.......there used to be a fudge factor allowed by cops, in that their radar guns to measure speed and PROVE IT in court weren't all that accurate...as technology improved and accuracy wasn't questioned, the cops can now bag you for doing 38 in a 35 zone and most judges will accept that......so, no, if the speed limit says 35 and you re doing 40 you can get a ticket.

honestly if you are going higher than the posted speed limit you CAN be busted. depends on the cop. my favorite speed is 45-50, be it a 15mph zone or a 55. however on the hwy i like to rest at 75. IF i get stopped you can bet i'll pay. it used to be $5 per mile over the speed limit. who knows what it is now??

I think it all depends where you are. Me I'm in Fairfax , VA .. an around here speed limits are just a suggestion , i see a sign for 40mph , most people are going about 50-55mph.
Most cops are kool with 5 over the limit .. but again it all depends where you live !

Follow the speed limit. People go over the speed limit when they shouldn't be, that doesn't mean that you should speed as well. Speeding causes car accidents.

Depends where you are. Here you can get by with going 5 over the limit without risking a ticket. Good Luck and watch that lead foot!

I always look at those signs as just a guide anyway. I think you are actually allowed to drive at whatever speed you want, but if the sign says 35, then they are suggesting that you drive at 35 on that particular stretch of road. If you hit someone crossing the road at 30, then they would probably survive. But, if you were driving at 50, then you would have passed them before they started to cross the road anyway, so they would definitely survive. Think about it.

in my state, you can get a ticket for going 36, but you will never get any points on your license. if it's your first ticket you can go between 40-44 w/o getting any points, but after the first ticket, any 5+ miles an hour over will get you points
