Indian judiciary gives judgements as per weather . In case of difficulty judgements are "reserved" for indefinite periods. If film stars are accused in serious crimes for poaching or anti national activities judgements are given after 20 years and then another 20 years are permitted for appeal. Prime minister and other politicians need not be natives of the state they represent in Rajya sabha. Office of profit means the office not liked by VIPs .Election petitions are disposed off only after the term of the house expires anyway. A soldier`s son or daughter is a non local everywhere in India because they do not stay in any place continuously for six years. Case about Ayodhya remains pending eternally and a poor wretched pickpocket gets beaten to death in illegal police custody.. That`s their competence

The judiciary is completely controlled by the politicians. If the judges do not give favourable judgement there is always the other way of amending the rules by an act of legislature or amendment to constitution. so it is not the question of Lower or higher court it is a question of how much muscle power can be utilised against the judge. If you have enough money you can even purchase the prime minister and president of India! what is judge in comparison?Justice is slowly disappearing from the scene.

Most judges of High Courts and all judges of the supreme court are highly competent. The same cannot be said of lower judiciary. talented persons would prefer to work as advocates in lower courts rather than become judges. main reason is money. currently the juniormost judge is paid aboout 12,000/-. if he does nto get promoted to high court, which is true of 95% persons, he would end up earning about 30,000/-. some of these judges try to make up from from other sources.
