i was in that situation with a child that i found out that wasn't mine and they sued me and i didn't get the papers for court well within one month they were taking out child support and finally i got that straight so yes you should be able to recieve it and they will just go after hime to repay it if you are getting work first or anything to that extent you will get a steady check if they are paying it to you like as in work first but if they are not you will only get a check when he pays it out of his check or on his own

if they found out hes working hes getting the papers at work. theyre going to take it out his check and ole well if they do forget that. if he doesn't respond the case just goes to default.
