Honestly, why don't you ask her.
Because legally if it is not handled properly if your husband dies she can insist that the child recieve some of the estate.
You all should work to get this matter cleared up.
The only reason that I could see her doing something like this would be because she was had grown accustomed to using her married name and didn't see the harm in it. It is easier when you have children who have the same last name that you do.
But this is a matter that you and your fiance need to work to get cleared up immediately.

If they are divorced then you are right she shouldnt have given her baby his last name but the bio.dads last name also to the poster who used the fact that you are black that's a bunch of crap watch Maury there are women of ALL Races who are not sure who the father is so I wouldnt take that personal but you shouldnt be worried as long as he isnt the babys father that means that he doesnt have to support the child.

These days there are so many women willing to do anything to break up a happy home. If your man is worth it dont let her do it. If you have the time take her *** to court if not dont worry about and just be glad that you got what she wants!

if she's using his last name until the day she remarries, she's going to want (for namesake) her child to have the same last name as her.
It's a way to prevent confusion at school.
No doubt, once she remarries, her child will pick up the new hubbies name.
