I lent money to someone, and am having trouble getting it back, it was less than 1000, and I know the person can pay, but they are now making excuses to not pay it back. I don't have a loan agreement, just email exhanges saying he will pay and the receipt to the place I paid for the person. This person moves all the time so I can't really file anywhere, and it's not enough money to go to court. Any ideas? I managed to get one payment but get nothing but empty promises and no payment. Any ideas? I know there's not much I can do but will take any suggestions.

keep proof of the loan transactions. you mentioned enough of them to have him or her admit it was a loan. keep all records including emails. that is your first step. now you need to talk to this person again

First off let me start by saying, I can understand that you are a trusting person and a upliftled giving person and there is nothing wrong with being this way, there are not enough friends let alone people in the world like you. Free hearted enough to lend money well let me tell you something I have 3 sisters 1 brother about 12 niece and 7 nephews and No One in my family can borrow money from me, let alone a friend. So ask them for it nicely one more time or use there last known address to go to the court house and file and small claim or HEY take it to Judge Judy !! Good luck with that.

Ask the person if the reason is, that they are finding it difficult to pay back the loan, or maybe they can afford to pay, but just find it hard to physically get around to doing it. Then make some kind of arrangement, like a periodic payment into your bank account, to reduce the loan, or suggest you will send a self addressed and stamped envelope to them, and ask that they just get a money order and post it back...

You'll probably never get your money.

Expensive lesson learned.

I've taken someone to small claims court. Even if you win (you will) the Judge nor Court force the person to pay. If they refuse you still don't have your money. That is what happened to me. Also, there is no punishment for not showing at small claims court. Also happened to me.

I think you need to talk to him.her and tell him he needs to be a real human. That this money was a favour and that they are not a charity. It also depends on age, I lent a friend money when I was underage and he way also underage and I called his mom to get the money back. It worked for me but I do not know if you are in the same situation as I was in.

Print the e mail messages and take him to small claims court. (no lawyers involved)

If you can't take him to court all you can do is try to guilt it out of him.
And NEVER lend money again.
