I need to find out if theres is a legal document that proves I have custody of my child, because no court was involved in my break-up with my ex partner. I just assumed that because he lives with me, it was enough to prove custody to the Immigration Dept in another country!

Health insurance, school records, a signed notarized statement from the ex. and child support receipts. etc.

Technically if you were never married then both of you have the same rights to the child. You need to go either to an attorney or your local child support enforcement and get an order stating you have custody of the child. The birth certificate will prove you are the mother but not custody.

What u do is pay like 25.00 to your state child support enforcement office and they will establish custody ,and childsupport for you.. .. but to me a birth certificate should be enough of a document especially given the fact that i assume u were never married.. usually based on that alone ur granted custody prior to a judgement to change that .. but id contact a lawyer and see what they have to say .. and possibly social services.. to seek as much help in this matter that u can..

For a Non-Marital Relationship, you will need to have the DNA testing done to prove once and for all that your ex-partner either is or is NOT the father of the child -- then that will be proof enough to be able to apply for a visa to visit the country of origin of the father.

Plus, you will need the DNA evidence anyway -- because both YOU and the Sperm Donor MUST sign in person for ANY Passport for the child if you are a US Citizen -- that is required.

You have a tough one on your hands. If the child was born in the US. he should have received a social security card. If you have custody you should also have his/her birth certificate. Best advice is to go and find a good lawyer to check into the matter for you so that you can get the matter cleared up legally. Then you can have the proof that you need.
