The right to congregate in public is protected by the first amendment. Any actions which are protected by the first amendment can be limited only to the extent that is absolutely necessary, and then only where there is alternate means of expression available.

For instance, many towns have curfews for students under 18, unless they have a valid reason for being out such as working nights. The reason for this is that children are prone to get themselves into trouble late at night, and it serves no useful purpose (with exception, see above), therefore it is behavior not strictly protected by the US Constitution.

Another angle is time-place-manner restriction. The government has the right to restrict you as long as the time/place/manner is reasonable. So restricting you from being out of your home without good reason (place) late at night (time) while only restricting you if you have no specific reason for being there that requires you to be there (manner) has been construed as a reasonable restriction on minors, because they can always be with an adult, have a valid reason, or just go during the day.

Actually I do ! I'm a mom of 5 kids and I believe it's MY decision when my kids come home and no one else's. Of course if there was some sort of danger in the neighborhood during a particular time and it was in the best interest of the community then... O.K. I would comply with the rules until the danger ban was lifted.

I think curfews are fine for those under 18 years of age.

it has more to do with the rights of other people; curfews are a pain, but put in place as communcities/cities/counties/states need them
