Ok my lease says that we can be evicted if we are late on rent(as does every lease). We had hired an accountant and she didn't pay our rent for 3 months. We have made the payments for 2 months and $400 of the $850 due for this month. My husband started a new job and won't get his first paycheck for another week. My question is if our landlord issues us an eviction notice for non-payment/late payment of rent and we pay it before the 30 days is up can we still be evicted? Like I said we've paid him more than half of the payment for this month and caught up all the payments that our accountant didn't pay.

He has talked to our accountant and she admitted to him that she just had the money sitting there and hadn't sent it. Before we hired her we were caught up and payments were on time. Future payments will be on time also-it's just this month.

Since your name here implies that you're someone's mom...the law is much more lenient on families than individuals or childless couples. However, the landlord does have the right to file for the eviction process to begin. The document should clearly state how much you owe and how soon you will have to come up with this amount if you are to avoid being kicked out. If you have made progress in coming up with the previous rent payments that were missed, your landlord will have trouble getting that final notice issued. This is a good thing! My recommendation is to beg or borrow the rest of this month's rent and have the next month's rent ready in the form of a cashier's check on the first day of the month. You will be on probation for the rest of your lease, so don't mess up, and I suspect you should be prepared to move in any case. Also, do whatever you can to PROVE (written) that your accountant (hopefully now PAST) was negligent...not you...this should go a long way in substantiating your case, if it has to go to court.

Per Ohio law, if your landlord has accepted ANY money from you, then the eviction is terminated. They have to begin the process all over again. Make sure that you get a receipt for the money that you have paid.

You also may want to set up a payment arrangement with the landlord now, and stick to it. Most landlords do not want to evict, and are willing to work with tenants with temporary hardships. Good luck.

If you pay your rent before your eviction notice expires, you are safe, you will no longer be evicted. Perhaps you can talk to you landlord and come up with an arrangement, maybe give half now, half later. Make sure you contact your accountant and make sure she pays your rent, as she agreed on the contract, otherwise you can fire her and file a lawsuit. My best advice on this for you, do this by yourself, pay your bills by yourself, why spend the money on someone else. You're spending more than saving.

You need to contact someone in your own state..but, i'd really be pissed at the account....sound like she is over paid.
