He didn't work for 3 of the 26 years we were married - had an affair and left. He is not working now.

my lawyer felt that a disolution would be a waste of time and that he would go after my retirement anyway. I just thought maybe someone knew of another way to get past this - I finished 30 yrs. of teaching this past May - but didn't retire and my x called me stupid - but as long as I don't retire he gets nothing. I will not receive anything from him- he spent every 401K at every job w/out any signature of mine. Show me where the balance is there

Why was this agreed to at the time of the settlement? What was the reasoning the husband gets the retirement? It's hard to appeal and change settlements after the fact. We would need more information to answer this. You probably need to consult a divorce attorney in your state.

I don't think there is such a thing as an appeal in a divorce settlement. You should have never agreed to it. But since you were married for 26 years, I bet that's what entitled him to some of your school retirement. You might need to talk with an attorney.

UNLESS that is the law in the state you live, I suspect that you need a better attorney (please don't use your union attorney... they're the worst of the crop wherever state you're in). IF he left, then he abandoned the home and you have grounds for divorce and not get screwed... especially if he screwed up 401K as you suggested (can you prove it?). Get another attorney and piss off the $100 or $150 consultation fee. It is so worth the $5,000 or $6,000 you may have to pay a good divorce attorney with experience in the divorce field, get an attorney that SPECIALIZES in divorce to divorce that bum and to rid yourself of him.

Many yrs in court and more money wasted. My mom was in prison for most of our young lives. When she finally wanted to make a life for herself and stay our of prison she went after my dads retirement from the school district, and won. Even though she was not around to share in the upbringing of the children or household.

The judge who ruled over this should be slapped!! So sorry to hear that this happened. But it seems to be more common then not.
