Ok my friend has been seperated from her husband for 3 years...all above board everything was split at the time of the seperation. Now she has a new home bought with her new partner and he was a new home bought with his partner. He is looking at getting married and wants a divorce however he doesnt want to pay and insists she pays half. No children are involved... she received a solicitors letter stating divorce proceeding were taking place and that she should contact the solicitor to agree by doing this her legal fees would be less they also advised her to get her own solicitor. She has done nothing about the letter and not got her own solicitor.. she has heard no more from her ex's solicitor.. so basically can her ex's solicitor ask the court to make her pay legal costs if she made no contact or refused to the divorce.. can she still get the divorce if she refused therefore hopefully not having to pay a penny? uk law...

In Australia, the party who requests the divorce has to pay the costs. For example, my ex wanted the divorce, so he paid for it and I just signed the papers and payed nothing. I'd imagine it was the same in the uk.

Not sure on UK Laws! In the US if it isn't court ordered at the time of the seperation/divorce than no she wouldnt have to pay anything. However; we have lawsuits here. So if her x wanted to sue her for 1/2 the money he can try.

Although i've been divorced twice i'm still not used to it lol..... but i would firmly advise your friend to get a solicitor. However i would think that if he wants to get a divorce, he will be the one who has to pay.

They can try to make you pay, but if you have a good enough lawyer, each pays for his and her own bill!
