my girlfriend's boyfriend was incarcerated and during that time his parental rights were terminated. He pays child support at the present time. they never talk about reestablishing the rights, does the mother have to initiate it or the father? she gets upset when he doesn't jump to her tune, but I try and tell her he has no rights, and the only obligation he has his child support, is this correct?

Rather than his parental rights being taken away, I think you are referring to custody and visitation rights. If he was stripped of his parental rights, he wouldn't even be paying child support. And the mother cannot go back into court to have them reinstated at will. This takes a court ordered evaluation of the situation first. If he lost visitation, that's different. That can be changed at the request of the parents. The mother would have to file a petition for modification of visitation with the court system. Until she does that, this man has no legal obligation to the child, other than his support order.

If his parental rights were terminated he shouldn't be paying child support anymore, as he's no longer considered the childs parent (it's like giving it up for adoption - you have NOTHING to do with it anymore)
