The road way must be designated as such by the government that owns it. Just because folks drive on public land does not make where they drive a road. It is a public highway when the public has the right to use it for driving. The roadway will be platted and designated as such.

All roads that are not owned by private individuals or companies and are looked after by the local council are public highways

a public highway has public access and can have traffic lights, a fwy has limited access(on/off ramps only). and then you have county and private roads, usually the differences are in the road signs(colors usually)
