Yes if your sons dad is alive then you do have to ask his permission and he will have to go to court and agree as he is handing over responsibility of being his sons father to someone else. If he agrees then your sons birth certificate will have adopted stamped on it.

Yes, if you know who the biological dad is, then you need him to relinquish his rights. Some guys think it's not "manly" to do this, so you might have a fight, even if he doesn't spend any time with your son. Some guys are asses that way. But if you don't get his permission and something happens to you, he can come in and take the boy from your husband. The good thing is, that if he won't give up his rights, then sue him for child support!

It all depends. My husband adopted my son without my ex's permission. We had had no contact with my ex for six years. It some states if there is no contact with the biological dad for more than a year you don't need permission.

Yes, you do. But would it be fair to you son as when he gets older he might decide he wanted to keep his biological father as his legal father rather than his step dad? It is a real hornet's nest, particularly if his biological father still has contact with him. The decision might be taken out of your hands if he refuses permission anyway. Even if you do want your husband to adopt your son, do you know that you too will also have to adopt him, even though he is yours !!! Yes, I do believe you need permission from the sons real dad.

In the US, you do. My childs original dad is not even allowed to have contact with my child, but if my husband now is going to adopt, he has to give his consent. Even to change my childs last name to be the same as my now married name, I would need her biological dads permission.
Dumb! A guy can walk out on his child, and then make our life difficult for the next 18 years without even paying child support!

Yes. You do. If that child has the fathers last name, or he has partial custody, or pays child support, yes, you need his total permission. He has to give up all paternal rights to the child before your husband can adopt your son.
My cousin just went through this.
Generally if he's young and paying child support the thought of not paying money or having that responcibility is more than enough motive for him to reliquish all rights.

if paternity has been established then yes...if not then no BUT if the father comes forward and says he is the real dad and he wants to contest the adoption he can. BUT if you can prove him unfit (like if he has never been a part of the boys life until now) then you will be able to go thru with the adoption

I think you should talk things over with your sons real father. Today, too many people have children and make fast decisions without looking at all the circumstances. You should also discuss this with your son as well, he has more say than anyone.

you have to let the biological father know what your intentions are. I am not sure if you need his permission but I know that you have to try to let him know. I know that was the way when my dad adopted me. My mother didn't know were by biological father was. She had to put an add in the paper for so long.
