I can't say for sure since I do not know where you reside. I can, however, say that it is at the landlord's discretion whether you get the apartment or not. It is based not only on your background check, but other things such as your credit score, physical appearance (ie, if you look like someone undesirable to the apartment complex), education level, job status, etc. It does not seem fair to be discriminated in this way, but when a landlord rents out an apartment, there is always a huge risk involved. Keep this in mind, if YOU were renting out a dwelling, would you want someone who had a bad credit score, possible felonies and a dirty, unkempt appearance? Most likely not.

I don't know what country you're in, you don't say. It can be a legal issue in most places. Wait and see if you get the apt or not. If not, then how bad do you want it? How hard are you willing to fight for it? That sounds like a Q for a lawyer.

I think most landlords are interested in your credit history. I would stress that when talking to him/her.
