I live in akron Ohio. Problems are occuring Wish to know what are my rights in order to fence in my section of the driveway

You probably "cant" fence in the driveway.

Go to the deeds office in your City, Municipallity or County and see what the former property owner agreement was, when they built the house. I bet that it says something to the effect that its shared and nothing can be build to interfere with traffic. Besides, if its been "long enough", then the drive way is community property between you both, and there isnt a thing you can do about it. Since its been from 1983, it IS community property between the houses and you would have to have your neighbors permission to build a fence, and since he/she probably wont give it to you, there is nothing you can do about it.

well for one unless you have an agreement i disagree, you CAN fence the driveway. I have a neighbor 2 houses down that did just that,,,and yes it upset the other neighbor, but it is your property ! I would double check with the town bulding dept first, but I suspect there should be no problem unless you have left out some improtant info

That is not a good idea you may make a bad enemy wouldn't it be better to be kind and thoughtful if you jest cant bring yourself to share you can check with your property appraiser to see if there is a deeded right of way if not check with a real estate lawyer if he says you can fence it off do what you have to do and fence it off you may be able to make the offender buy an access easement

IF THERE WAS ANY AGREEMENT PRIOR TO YOUR BUYING THE PLACE, YOU SHOULD HAVE RECEIVED A COPY AT CLOSING AT TITLE CO. OTHER THAN THAT YOU WILL BE BOUND BY THE LAWS OF THE STATE THAT WILL TELL YOU IF YOU CAN WITHDRAW ACCESS FROM THE OTHER USER. IT WILL DEPEND ON THE LENGTH OF TIME HE HAS HAD ACCESS TO IT. YOU CAN ASK A REALTOR TO START WITH AND I BELIEVE A LAWYER NEXT TO GET THE REAL ANSWER. I WOULD GO TO THE LIBRARY FIRST AND READ THE LAW THERE. IT ISN'T TOO COMPLICATED-IT MAY BE CUT AND DRIED.

We had a problem with a shared driveway and had to see a lawyer to find out what our rights were and get it straightened out. Its a real nuisance.

instead of mending the fence, mend the problem instead.
