You have to petition the courts for a name change for your daughter. It's an easy matter to do & not very costly. An atty can do the paper work & appear before the judge for you so you don't even have to go to court. Look for one who practices family law.
I did it when I married my ex - we had our son's last name changed to his because I had been using my maiden name & so had my son. (I wasn't gonna marry the sucker - now he's my EX & I wish I never had!!! lol)
p.s. - was reading previous responses - if he is her father, then NO he does not have to adopt her in order to change her name. If he's not her father, then the matter does change & the atty will need to advise you.

To change it legally, you'll have to go through the court system. Your local county courthouse should have forms to fill out to do this. Here, there is a fee and if the father of the child is still living and has paid child support in the last 2 years, you'd have to get his written, notarized permission to change the last name. More than 2 years, he will just have to be notified in writing at his last know address of your intent. If your new husband would like to adopt the child, you can change the name then but it is a much more complicated procedure and here you have to be married for a year before your husband can adopt your kids. (At least that's how it works here.) Good luck.

I just changed my daughters name to ours about 6 months ago. I made a petition to court to have her name changed(it helps to have an attorney - legal aid was great). We went to the small claims hearing and presented the opposition and the judge awarded in our favor. You then must contact social security for an application to have her name changed on her social security card (just contact your local social security office). You will need proof of identity when you file this (birth certificate, school records, shot records, something like that). It's not a hard process at all. And because her biological father choices to remain inactive in her life and is paying no child support, I did not have to have his permission to do anything. I don't think you would anyway, since she lives with you, its obvious you have soul custody; what the ex-father thinks doesn't matter.

You can change her name but you have to get permission from the father and petition the court for the name change. We had different last names in my family and it never affected us. The parents are the ones who take care of the child not the just the ones who make them. But if her father agrees and your husband agrees and the court agrees then you can change it

If you are receiving chaild support ans her father is in her life or not . she will keep her name. You have to seek the fathers oermission to chage her name and give up his rights. You have to file a petitin with the family law courts. You should talk to a family law councelor about it. New letter summons can be published seeking for him for a court hearing ,but it must be filed through the courts. You nedd a Lawyer.

i believe your husband would have to adopt her. this happened to a family member of mine and the husband had to adopt the girl from another relationship. i don't think it's a hard process...he has to become her legal gaurdian and whatnot.
