get a lawyer and get it in writing when he was out of the house. If you have to sell sue him for your lawyer fees plus what he owes you on what you paid and he did not pay during this time!

Consult an attorney and fast! You don't want your credit ruined because he isn't keeping up his end. He may feel that since he's no longer there, he's no longer responsible, (as people sometimes do regarding financial responsibility), in which you probably need a quit claim to have his name removed from the property and to refinance to have his name removed from the loan.
He may be entitled to something so definitely consult with an attorney. At the very least, the attorney may get a court to issue an order requiring him to continue paying on the mortgage until such time as the property can be sold.

I think this kind of situation ends up with one person buying the other out at the date the other stopped payment, you need to get an evaluation for this - you may already know of similar property in your area being sold recently.
Or, because it is not possible to raise the extra finance the house must be sold and the proceeds split between the two of you.
Either way get a lawyer as soon as possible unless you can get an agreement in writing from your ex. even then it may be advisable to get a lawyer!

I would go to the bank that you have your mortgage with and talk to them. Also I would get a good solicitor as you may well need one if you want him off the mortgage agreement..
Those in mind, Im sure they will be able to answer any questions you have..
Good luck

Thats a dodgy one. Because his name is on the property he will be entitled to any money from the sale of the house. If you manage to get his name off the property then all the money will be yours. You might have to buy your ex out though. Very complicated but you should speak to your lawyer they'll know more than me.

consult a lawyer. if i were you I'd stop paying the mortgage too... or talk to the bank manager, they will surely tell you the best advice as I am sure you are not the first couple going through this.

I don’t know the answer to your question, but you may find that if you don’t get the response you are after in this Category, you may do better to ask the question in the Politics & Government - Law & Ethics Category.
You will probably find you will have more ‘legal minds’ trying to help you in that Category.
I hope things work out for you !!!

you need to seek advice fast from your mortgage people and from a solicitor. do not take advice from anyone other than them and you will know exactly where you stand. they will talk to you over phone if you cant go in person. get this sorted out asap and dont let him make a mug out of you
