I assume you are in the UK as you as you have used UK terminology rather than the US "restraining order". Look in the Yellow Pages under Solicitors and see which ones specialise in Family law. In addition, see if any of them do free half hour interviews and/or legal aid or fixed fee interviews. If you are on a low income you may well be able to get this done on public funding. Personally I would not recommend you try to do this without a lawyer's help. I think you will have to attend court to give evidence, but if the circumstances are bad enough, the application might be done on an "ex parte" basis, i.e. your ex is not told and does not attend court.

Whatever you do, don't let him get away with harassing you.

Another thing I would suggest is that whenever he does anything that warrants it, you do call the police. Once they have been called out twice on the same situation (i.e. him harassing you) then your ex will become liable under the Protection from Harassment Act 1997 and the police will be able to take action against him. I would recommend that if they do, you co-operate with them fully and don't bottle out. It's important you carry it through.

Good luck.

There are things you can do using both civil and criminal procedures.

Solicitors and courts deal with civil injunctions - go to citizens advice or a solicitors office for details.

Also, if you feel the level of harassment is very high, or the things your ex is doing might become violent, you can get the police involved. Under the Harrassment Act, your ex will be warned by the police and then any further incident will make him immediately arrestable, even if the thing he is doing is not a crime in itself (e.g. sending loads of text messages, hanging around outside your house etc.)

Either way, you will need to provide some evidence, so if he sends voicemails, emails, texts, letters, answerphone messages etc. save them. Make a note in a diary or logbook of any behaviour you consider to be harassment - even if it's just turning up and hanging around when you have told him not to. If you can get witnesses - preferably ones who are not your own family, friends (e.g. neighbours, work colleagues), that is even better.

The two are not mutually exclusive; you can have him warned under the harassment act and get a civil court injunction at the same time, or consecutively.

Speak to a solicitor and they will send a letter to them free of charge. If it gets any worse advised the solicitors again and they will approach the court and place a injunction. It will cost a little bit for admin fees. but if he breaches it he will be arrested

Have you spoken to the Police? It is or can be a criminal charge.
Other options are solicitor or go to County Court and staff in office will guide you through procedures - it costs though!

Harrassment is actually a criminal offence, that needs to be reported to the police.
