Today I got fired from a part time job at a tanning salon. Saturday was the last time I worked and during my shift the manager came in (who happened to be there to tan even though she wasn't working). I was in the middle of a sale with a $50 commission tacked on it and I asked her how to complete some paperwork. She went ahead and signed her name for the commission. I complained to the salon owner about it in a phone message but never heard back from her. Today when I went to get my check the manager told me she had to let me go. Does the whistleblower law or any other laws (in New Jersey or the US) protect me or allow me to file a lawsuit? Thank you

Hey Mike,

Well, you certainly have made a mountain out of a part-time job.

First, you didn't whistle-blow. If they didn't pay you what you were owed, you need to call your Hour and Labor office in NJ.

Second, You were part-time, so proving any real loss will be very hard. If you were there less than 90 days (most states) you can be let go, Without notice. In many states (like California) the laws are "At Will", meaning that without a union contract, an employer hires you "At Will" and can let you go at any time, without cause. They would still, as the employer, have to prove cause in court.

Third, You can sue for anything! Its getting a lawyer that will be the hard part. They won't take your case because your damages will be very small. The legal bills will be a portion of the settlement.

Lastly, It was a part-time job! Get another! What was so special about that job? This is a door opening for a job that might be more to your liking.

The whistle blower act is for reporting to the authorities or government agencies an illegal or such acts by your employer. This would allow 6 months of income if it is found they retaliated against your complaint and fired you.

If you feel you were wronged, you can talk to a lawyer about wrongful termination. Good luck Hon!
