It is a photo that came up missing from my photo collection. It was clearly put in the program as a threat or a tease.

OK--no one else has bitten, so I will.

What in the hell are you talking about, a picture came up missing from your photo collection? A photo collection on line? An album at home? Did someone break into your house and steal a photo?

What kind of photo is a threat? Or what kind of photo is a tease?

This makes no sense. And my biting on it makes even less sense.

you state that the photo in the software is a threat or tease. I am going with the assumption that the photo is being used such as a voodoo doll might. Perhaps you as being played and they are using you as a puppet.

FOR CRYIN OUT LOUD!!!

If it is like your Driver's License photo, OK worry.
Let's get real here. Without knowing how or where the photo is used or your relations, rank in file, ceiling reach, etc...

Be a team player unless the company does something bad or makes money off your IP(intellectual property)
contracts should be reviewed.
Always play for a win-win solution.

In order to sue you would need to be able to prove that this is your picture. Was this a digital picture or do you have a negative. If you have a negative then you are in a stronger position. If you can't prove ownership even if it's your pictuer you are going to have a hard time doing anything about this. ALSO, where you working for this company at the time the picture was taken? If so they may claim that the picture was taken on they behalf by you during your employment. Again it's going to be hard to do much about it.

Your best bet may be to go and talk to them calmly and tell them that you are prepared to give them permission to use the picture foa a fair royalty payment ... don't be greedy if you can't prove ownership because they may just tell you to take a hike and then you are stuck. ...

If you seriously want to stick it to them you could see if there is a way to legally record them admitting that they used your picture without your permission ... you might be able to use that if you want to sue..

You mean to say that your Private picture folder become Public.Ask the company,If your picture to be private or otherwise ..

Sue. You have all legal rights if they don't have permission to do that.
