Murder was legal until it was classified as illegal! Thus slavery likewise was legal without any proven objections. Initally slavery was no different in character than indentureship and that said the first slaves were brought to the coloney at Jamestown Virginia and the laws covering indentured persons were extended to slaves who alternatively had no criminal history.
Evenutally the race factor and the business potential in slave marketing led political minds and legal speculaters to enact laws that would classify slaves as inferior and these started in Virginia then the Carolinas and Georgia.

Check out the source below -- it has a lot of information on the subject.
According to one of the entries on that page, the first African slaves were brought by the Dutch to Jamestown, Virginia in 1619. Officially, they were considered to be indentured servants (a common situation at the time)...but slaves nonetheless. A law "legitimizing" slavery wasn't passed until 1661.

I don't think it was illegal anywhere at the beginning, but rather made illegal later.
